The Texas Legislature enacted the Workers’ Compensation Act in 1992. According to that law, employers who purchase workers’ comp get special incentives: unusual protection. The chief protection for employers who pay for workers’ comp coverage is that – with one most unusual exception – they cannot be sued for any more than a capped amount of compensation.
